These terms are the agreement between you and StableSense, Inc., a Delaware corporation doing business as HopOn, for the use of the HopOn app and website. By creating an account or using the app, you accept them. If you are accepting on behalf of a stable, you confirm you have the authority to bind it.
1. What HopOn is
HopOn is software for running a stable: planning the day, recording horse care, coordinating a team, communicating with clients, and issuing invoices. HopOn is a tool. It does not board horses, does not employ your staff, and is not a party to the agreement between a stable and its clients.
HopOn does not provide veterinary, farrier, nutritional or medical advice. Records you keep in the app are your records. Decisions about a horse's health, feed, medication and welfare are yours and your veterinarian's. Never rely on the app in place of professional judgement, and never rely on it alone in an emergency.
2. Accounts and roles
You must be at least 18 years old to create an account. Keep your credentials to yourself and tell us promptly if you think someone else has used them.
A stable owner invites staff and clients and assigns each of them a role that determines what they can see and do. The stable is responsible for who it invites, for the roles it grants, and for the accuracy of what it records. If you are invited to a stable, the stable's owner can see the content you create there and can remove your access at any time.
3. Your content
Everything you put into HopOn stays yours: horses, records, photos, prices, plans, invoices. You give us the limited licence we need to host it, display it to the people you have authorised, back it up, and operate the service. We do not use your content to advertise, and we do not sell it.
You are responsible for having the right to upload what you upload, including photos of people, and for complying with the law where you operate.
4. Money
The current beta helps stables organize services and billing information but does not process payments. When integrated payments are introduced, the stable will remain the merchant of record for boarding, care and lesson services, and separate payment-provider terms will apply.
HopOn charges a service fee for use of the platform. The fee in force, how it is calculated and when it is taken are shown in the app before you enable payments, and we will give you notice in the app before we change it. Fees already incurred are not refundable.
Contracts, prices, invoices and boarding plans generated by the app are built from what you enter. You are responsible for reviewing them before you send or sign them. HopOn provides the structure, not the legal advice.
5. Acceptable use
- Do not use HopOn to break the law, to harass anyone, or to record data about a person without the right to do so.
- Do not attempt to access another stable's data, probe our systems, or interfere with the service.
- Do not copy, resell or reverse engineer the app.
- Do not upload malware, or content that is unlawful or that you do not have the right to share.
6. Availability
We work to keep HopOn running and to keep it fast in places with poor signal, but we do not promise uninterrupted service. We may change, suspend or discontinue features, and we will give reasonable notice before removing something you rely on.
7. Ending the agreement
You can stop using HopOn and delete your account at any time from the app. We may suspend or close an account that breaches these terms, or that puts the service or another user at risk. Before we close an account for breach, we will tell you why and, where it is reasonable, give you a chance to fix it.
When an account closes, we keep and delete data as described in the Privacy Policy. Export what matters to you before you delete.
8. Warranties and liability
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT.
TO THE FULLEST EXTENT PERMITTED BY LAW, HOPON WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES, OR FOR LOST PROFITS, LOST REVENUE OR LOST DATA. OUR TOTAL LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS WILL NOT EXCEED THE GREATER OF ONE HUNDRED US DOLLARS OR THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM.
NOTHING IN THESE TERMS LIMITS LIABILITY THAT CANNOT BE LIMITED BY LAW, INCLUDING LIABILITY FOR FRAUD, OR FOR DEATH OR PERSONAL INJURY CAUSED BY NEGLIGENCE.
You agree to indemnify HopOn against claims arising from your content, your use of the service, or your breach of these terms.
9. Equine activities
Horses are dangerous animals and equine activities carry inherent risks. HopOn is a record-keeping and scheduling tool and assumes no responsibility for what happens in a barn, an arena or a trailer. Stables remain responsible for their own liability waivers, insurance and compliance with the equine activity statutes of their state.
10. Apple and Google
If you obtained the app from the Apple App Store or Google Play, you also accept those stores' terms. Apple and Google are not parties to this agreement, have no obligation to support the app, and are third-party beneficiaries entitled to enforce these terms against you.
11. Changes to these terms
We may update these terms. If a change is material we will tell you in the app or by email at least 14 days before it takes effect. Continuing to use HopOn after that means you accept the new version.
12. Governing law
These terms are governed by the laws of the State of Delaware, without regard to conflict of law rules. Disputes will be brought before the state or federal courts located in Delaware, and both parties consent to that jurisdiction. If you are a consumer in the European Union or the United Kingdom, this does not deprive you of the protection of the mandatory laws of your country of residence.
13. Miscellaneous
If any provision is found unenforceable, the rest stays in force. Our failure to enforce a provision is not a waiver of it. You may not assign this agreement without our consent; we may assign it in connection with a merger or sale of the business. These terms and the Privacy Policy are the entire agreement between us about the service.
